Terms of Service

This is a legal agreement between you and the BOOSTEXP platform provided by BoostingExperts Global Inc, Identification Number 93-2664315, located at https://boostexp.com, together with affiliated websites, mobile websites, applications, services, and products that link to or reference this Agreement.

BoostingExperts Global Inc provides a platform where individuals seeking in-game training and assistance, called Clients, and professional players and experts offering such services, called Service Providers, can identify each other and engage with each other for the provision of services.

Through the BOOSTEXP Services, BoostingExperts Global Inc facilitates services between Users but does not act as a party to the provision of such services or to contracts formed directly between Clients and Service Providers.

YouTube API Services

Use of BOOSTEXP Live and YouTube API Services is also subject to the YouTube Terms of Service. A staff member who connects a channel represents that they are authorized to manage that channel on behalf of BOOSTEXP.

Within an action confirmed by an authorized staff member or assigned Expert, BOOSTEXP may create, bind, start, and end an unlisted broadcast and its ingestion stream. BOOSTEXP may delete only unused broadcast or stream resources created by the integration for that confirmed action; completed broadcast recordings are retained unless separately removed by an authorized channel manager or required by law.

Channel access can be disconnected in BOOSTEXP or revoked through Google Account permissions. Our collection and deletion practices are described in the Privacy Policy.

1. Acceptance of Terms of Service

By accessing or using the BOOSTEXP Services, you agree to these Terms of Service, our Privacy Policy, and any additional terms that apply to specific programs, products, or portions of the BOOSTEXP Services. If you do not agree, you must immediately stop accessing or using the BOOSTEXP Services.

By registering an account, placing an order, or clicking to accept these Terms where prompted, you are deemed to have executed this Agreement electronically. Your account registration is an acknowledgment that you can receive, download, and print this Agreement and any amendments.

2. Changes to These Terms

We may discontinue or modify any part of these Terms of Service when we deem it necessary or desirable. We encourage you to review this page from time to time so you remain informed about the current terms governing the BOOSTEXP Services.

Your continued use of the BOOSTEXP Services after an update constitutes acceptance of the modified Terms. We may also change or discontinue any feature or requirement for access to or use of the BOOSTEXP Services.

3. Ownership of the BOOSTEXP Services

As between you and us, you own Your Content. We own the BOOSTEXP Services content, including visual interfaces, interactive features, graphics, design, software, products, mobile applications, aggregate review ratings, and other elements and components of the BOOSTEXP Services, excluding Your Content and other user content.

We own the copyrights, trademarks, service marks, trade names, and other intellectual and proprietary rights associated with our content and the BOOSTEXP Services. You may not modify, reproduce, distribute, create derivative works from, publicly display, or otherwise exploit our content except as expressly authorized by us.

For these Terms, Your Content means any information, messages, images, photos, videos, files, personal or technical data, or other information that you transmit or post through the Services.

4. Using the BOOSTEXP Services

Eligibility

To access or use the BOOSTEXP Services or create an account, you must be an individual at least 13 years old who can form legally binding contracts. If you are between 13 and the age of majority where you live, you must review these Terms with a parent or guardian.

You may not access or use the BOOSTEXP Services if you are a competitor of BoostingExperts Global Inc, if we have previously banned you, or if we have closed your account.

Site Availability

The BOOSTEXP Services may be modified, updated, interrupted, suspended, or discontinued at any time without notice or liability.

User Accounts

You may need to create an account and provide information about yourself to use parts of the BOOSTEXP Services. You agree to provide true, accurate, and complete information and to keep it current.

You may not impersonate another person, use a name that is not your own, create or use more than one account unless expressly authorized, share your account, or disclose your password to any third party.

We may refuse, suspend, or revoke access to the BOOSTEXP Services if information you provide is false, inaccurate, incomplete, or if your conduct violates these Terms.

Relationship Between Service Provider and Client

BoostingExperts Global Inc provides a platform where Clients seeking in-game training and assistance and Service Providers offering such services can identify each other and engage with each other. BoostingExperts Global Inc facilitates the provision of services but is not a party to any contract between Clients and Service Providers.

A service contract may be formed directly between a Client and a Service Provider when the Client accepts an offer through the Services. The formation of such a contract does not create an employment, agency, joint venture, or other service relationship between us and any User.

Service Providers perform services as independent contractors and are solely responsible for the manner and means of performance. If a Service Provider uses assistants, the Service Provider remains responsible for their actions, obligations, costs, and compliance with these Terms.

5. Payment Terms

Client and Service Provider Accounts

After a Client makes a purchase and transfers funds to BoostingExperts Global Inc, we may establish and maintain a Client Account to hold funds for payments under contracts and service fees. After a Service Provider registers and provides a payment method, we may establish and maintain a Service Provider Account for receiving payments, withdrawals, and applicable fees.

Funding and Release of Funds

When a Client and Service Provider enter into a contract, the Client authorizes BoostingExperts Global Inc to charge the selected payment method for the agreed fees. Users authorize us to receive, hold, and release applicable funds in accordance with these Terms and internal procedures.

Clients and Service Providers are encouraged to resolve cancellations and refunds by mutual agreement. Where a refund is required, the share returned to the Client is generally determined as follows:

100% if service provision has not started and a Service Provider has not been assigned to the order.
90% if service provision has not started, or progress is immaterial, but a Service Provider has been assigned to the order.
A pro-rata amount if a material volume of services has already been provided.

Disputes, Non-Payment, and Chargebacks

If Users cannot resolve a cancellation or refund request, BoostingExperts Global Inc may review the dispute and propose a binding resolution based on information and documentation available to us. A dispute request must be made no later than 30 days after the last provision of services under the relevant contract.

If a Client fails to pay contract fees, cancels a card, initiates an improper chargeback, or otherwise fails to complete payment, we may suspend or close the Client's account, revoke access to the BOOSTEXP Services, and seek all remedies available under law.

Taxes, Service Fees, Payment Methods, and Installments

Service Providers are responsible for determining and paying any taxes, value-added taxes, withholding amounts, or similar charges that apply to their services unless applicable law states otherwise.

Fees for using the BOOSTEXP Services may be paid by Clients and may be deducted from contract fees or charged through accepted payment methods. A Payment Method may include a valid credit card, debit card, bank account, PayPal account, or another method accepted by us.

A Client may purchase BOOSTEXP Services by installments if such a payment plan is offered. A Client must not have more than two open installment plans at the same time.

6. Responsibility for Your Content

You alone are responsible for Your Content and assume all risks associated with it, including reliance on its accuracy, quality, or reliability, and any disclosure of information that makes you personally identifiable.

You represent that you own or have the necessary rights and permissions to use and authorize use of Your Content. You may not imply that Your Content is sponsored or endorsed by us.

You agree not to transmit content that is unlawful, harmful, abusive, defamatory, infringing, invasive of privacy, threatening, obscene, discriminatory, misleading, spam, designed to solicit credentials, or otherwise objectionable. We may reject or remove Your Content that we believe violates these Terms.

You agree that you will not use the BOOSTEXP Services to gain an unfair advantage or cheat in any game played with third parties. The BOOSTEXP Services are intended to improve player skills and support lawful, permitted gameplay assistance.

7. Our Right to Use Your Content

You grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, copy, display, distribute, modify, translate, and create derivative works from Your Content in connection with operating, promoting, and improving the BOOSTEXP Services and related media.

You also grant users of the Services and related media the right to access Your Content in connection with their use of the Services. Your Content will be treated as non-confidential and non-proprietary and will not be returned.

8. Restrictions

You agree not to use, assist, encourage, or enable others to use the BOOSTEXP Services to violate third-party rights, harass or harm others, send spam or mass messaging, solicit personal information from minors, transmit unlawful content, or violate any applicable law.

You also agree not to modify, exploit, scrape, index, reverse engineer, frame, overload, interfere with, or attempt unauthorized access to the BOOSTEXP Services or related systems. You may not remove proprietary notices, mine information about other users, transmit viruses, circumvent security features, or use the Services in violation of applicable game terms.

9. Limitation of Liability

Please read this section carefully. To the maximum extent permitted by applicable law, BoostingExperts Global Inc and its subsidiaries, affiliates, agents, employees, officers, directors, and licensors are not liable for losses or damages arising from your use of the BOOSTEXP Services.

The BOOSTEXP Services are made available on an "as is," "with all faults," and "as available" basis. Your use is at your own discretion and risk. We make no promises about quality, accuracy, reliability, safety, security, or availability of the Services or content.

Your sole and exclusive remedy for dissatisfaction with the Services is to stop accessing or using them. Our maximum aggregate liability is limited to the greater of the amount you paid to us in connection with the Services in the six months before the event giving rise to liability, or $100.

We disclaim liability for indirect, special, incidental, punitive, exemplary, reliance, or consequential damages, loss of profits, business interruption, reputational harm, and loss of information or data.

10. Indemnification and Release

You agree to defend, indemnify, and hold harmless BoostingExperts Global Inc and its related parties from claims, damages, obligations, losses, liabilities, costs, debts, and expenses arising from your access to or use of the BOOSTEXP Services, your violation of these Terms, your violation of third-party rights or law, Your Content, or another party's use of your account credentials.

You acknowledge that BoostingExperts Global Inc is not a party to contracts between Users and release us and our officers, directors, agents, subsidiaries, joint ventures, and employees from claims, demands, and damages connected with disputes you have with another User.

These indemnity obligations survive expiration or termination of your relationship with us.

11. Termination

You may terminate these Terms at any time by closing your account, discontinuing use of the BOOSTEXP Services, and providing us notice of termination.

We may close your account, suspend your access, or ban you from the BOOSTEXP Services for any or no reason, without notice or liability. Termination does not relieve a Client of the obligation to pay for services performed before termination or under contracts entered into before termination.

12. Non-Circumvention

BoostingExperts Global Inc has invested substantial effort to connect Clients and Service Providers through the BOOSTEXP Services. You agree not to circumvent or attempt to circumvent us by procuring or offering services to Users identified through the BOOSTEXP Services outside the Services, or by bypassing our payment processing or payment methods.

13. End User License Grant

Subject to these Terms, you receive a non-exclusive, limited, non-transferable, freely revocable license to use the BOOSTEXP Services for personal, non-commercial use unless otherwise permitted by these Terms.

You may not copy, scrape, extract, reproduce, modify, republish, download, post, distribute, disassemble, decompile, reverse engineer, rent, lease, loan, resell, sublicense, or transfer any part of the BOOSTEXP Services or related mobile software except as expressly authorized by us or required by law.

Any third-party code incorporated into our software may be governed by the applicable open source or third-party license.

14. Your Relationship with BoostingExperts Global Inc

You acknowledge that the BOOSTEXP Services serve as a venue where Users may act as Clients or Service Providers. BoostingExperts Global Inc is not a party to contracts between Clients and Service Providers and does not supervise, direct, or control Service Providers or their services.

BoostingExperts Global Inc makes no representation as to the reliability, capability, qualifications, quality, security, legality, or completion of services offered or rendered by Service Providers, or the ability of Clients to pay for services.

15. Dispute Resolution

Unless you opt out within 30 days after first agreeing to these Terms by emailing [email protected], disputes between you and BoostingExperts Global Inc will be resolved by binding, individual arbitration, and you waive the right to participate in a class action lawsuit or class-wide arbitration.

Arbitration will be administered and finally settled under the Rules of Arbitration of the International Chamber of Commerce then in force, by one or more arbitrators appointed in accordance with those rules, as modified by these Terms.

Each party reserves the right to seek injunctive or other equitable relief in a court of competent jurisdiction for disputes related to actual or threatened infringement, misappropriation, or violation of intellectual property or proprietary rights.

If we change this dispute resolution section, you may reject the change by sending written notice to [email protected] within 30 days after the change becomes effective.

16. Miscellaneous

User Disputes

Except as expressly stated in these Terms, we are not responsible for addressing disputes between Users. Users should communicate directly with each other to resolve concerns, claims, or disputes.

Entire Agreement and Severability

These Terms, together with any amendments and additional agreements you enter into with us regarding the BOOSTEXP Services, constitute the entire agreement between you and us. If any provision is deemed invalid, the remaining provisions remain in full force and effect.

No Waiver and Assignment

No waiver of any term is a further or continuing waiver of that term or any other term. You may not transfer or assign this Agreement or any rights or licenses granted under it, but we may assign it without restriction or notice.

Users Outside the United States

If you use the BOOSTEXP Services from outside the United States, you consent to having your personal data transferred to and processed in the United States. If you are located in a country embargoed by the United States or are on a restricted sanctions list, you may not engage in commercial activities using the Services.

Third-Party Links

The BOOSTEXP Services may contain links to third-party websites, advertisers, services, offers, or activities that we do not own or control. We do not endorse or assume responsibility for such third-party sites, materials, products, or services.

Notices

We may provide notices by email, written notice, hard copy notice, or posting on https://boostexp.com. You consent to receive records and notices electronically and may withdraw consent by contacting [email protected], subject to a reasonable processing period.

Users are responsible for maintaining a current, active email address, checking email, and responding to notices sent to the registered email address.

Governing Law

The laws, excluding conflicts-of-law rules, govern this Agreement. The UN Convention on Contracts for the International Sale of Goods does not apply to this Agreement or any dispute or transaction arising from it.
